What is Local Law 84?

Created in 2009, as part of the Greener Greater Buildings Plan, Local Law 84 requires buildings that are 50,000 square feet or larger to benchmark their energy performance and water usage against other similar buildings in the database. What is energy benchmarking?

Energy benchmarking is the process by which recent past energy usage patterns of a building are measured, rated, and analyzed. These results are then compared to those of similar buildings nationwide. Energy benchmarking is carried out through the utilization of the Environmental Protection Agency’s (EPA) free online Energy Star Portfolio Manager software.

Is there a deadline to comply with Local Law 84?

Yes. The first benchmarking report was due May 1st, 2011, and the compliance date remains every May 1st thereafter. This means that energy consumption information must be uploaded to the EPA Portfolio Manager website and data submitted to the City of New York by May 1st annually.

What are the penalties and fines for not complying with Local Law 84?

Benchmarking for calendar year 2014:

The deadline for submitting your calendar year 2014 benchmarking report is May 1st, 2015. If the deadline is violated, the penalty is $500 per quarter until the report is submitted. Once the fines are paid, they will stop compounding but you are still required to pay all outstanding fines.

Fines for submitting reports after:

May 1st, 2015 = $500

August 1st, 2015 = $1000

November 1st, 2015 = $1500

The deadline for submitting your 2012 benchmarking report is May 1st, 2013. If the deadline is violated, the penalty is $500 per quarter until the report is submitted. Once the fines are paid, they will stop compounding but you are still required to pay all outstanding fines.

Fines for submitting reports after:

May 1st, 2013 = $500

August 1st, 2013 = $1000

November 1st, 2013 = $1500

 

Benchmarking in 2010

New York City buildings that failed to file their energy benchmarking reports by the May 1st deadline were served violation notices from the Department of Finance.

If you did not file the report by 12/31/2011 and received a notice of violation, you are required to pay a fine of $500. After paying this fine, you are cleared from any further obligations to report your 2010 energy benchmarking usage.

Why was Local Law 84 enacted?

Residential and commercial buildings are responsible for 80% of all greenhouse gas emissions in the City of New York. In order to make significant strides towards reaching Mayor Bloomberg’s goal of lowering emissions by 30% by 2030, a policy like Local Law 84 was set in place.
